An expert is a person with proven specialized knowledge in a specific field who, on behalf of private individuals, courts, government agencies, or insurance companies, prepares expert reports and makes assessments that require specialized expertise. In the real estate sector, experts are involved in the valuation of land and buildings (appraisal), the assessment of construction defects, and valuations in the context of inheritance, divorce, or legal disputes. Qualifications and licensing vary considerably depending on the context.
The term “expert” is not legally protected in Germany-theoretically, anyone can use it. However, recognized qualifications are required for use in court and in administrative proceedings. The most important ones are:
Publicly appointed and sworn experts (ö.b.u.v.) are appointed by the Chambers of Industry and Commerce (IHK) or Chambers of Crafts based on strict professional and personal requirements. They must demonstrate five years of professional experience, pass a rigorous professional examination, and are obligated to remain impartial and independent. Their appraisals carry the highest evidentiary weight in court and before government agencies.
Certified experts in accordance with DIN EN ISO/IEC 17024 are certified by accredited certification bodies such as DEKRA, TÜV, or HypZert for financial service providers. HypZert certificates are the standard for determining mortgage lending values at banks-without this certification, many banks will not accept the appraisal as the basis for a loan decision.
In addition, there are independent appraisers without state or accredited recognition who, thanks to their many years of experience and expertise, can still provide valuable assessments-though these do not carry legal evidentiary weight.
Real estate appraisers are consulted in numerous situations: when buying or selling a property to determine market value and identify hidden defects; in inheritance cases to appraise real estate for estate tax purposes and the distribution of the estate; in divorce proceedings to determine the equalization of accrued gains; in cases of insurance claims (water, fire, storm) to assess the damage; in building permit proceedings and zoning plan processes; and in court as a court-appointed expert.
Buyers should always consult an independent expert when making significant investment decisions, as the expert has no financial stake in the outcome of the transaction. Real estate agents, sellers, and developers naturally evaluate the property from their own perspective; an independent expert provides a neutral assessment.
In the real estate sector, there are two distinct specializations that are often confused. The valuation expert (real estate appraiser) determines the market value or mortgage lending value of a property using recognized methods (cost approach, income approach, and sales comparison approach). The building inspector assesses the structural condition of a building, identifies defects and damage, and estimates the costs of repairing them.
Many qualified experts are proficient in both fields; however, for specific questions, the respective specialist is the better choice. When purchasing a new construction, a building inspector with knowledge of modern construction methods is more important than a valuation expert; in the case of an inheritance with no apparent defects, the valuation expert takes precedence.
The cost of an expert appraisal depends on the type and scope of the assignment as well as the market value of the property. A full appraisal for an apartment costs €800-2,500, depending on the region and scope; for a single-family home, €1,500-4,000 is typical. Short reports or market price estimates (plausibility checks) are less expensive (€300-800), but carry less evidentiary weight. Court-ordered appraisals are billed in accordance with the German Act on Remuneration and Compensation for Judicial Services (JVEG).
When selecting an appraiser, it is advisable to pay attention to specific certifications and regional market knowledge. An appraiser from another region may not be sufficiently familiar with local standard land values, market trends, and location assessments-which can lead to an inaccurate valuation.

We recommend: For every major real estate purchase (starting at approx. €200,000), commission at least a qualified inspection by a building expert, even if it is not a full appraisal. Two to three hours of an expert’s time for €300-500 can help you identify hidden defects that would later cost tens of thousands of euros in renovations.

In doing so, we take care to recommend experts who have specific experience with the respective property type and the location in question-because market knowledge is crucial in determining value.
These terms are often used interchangeably in everyday language. In a legal sense, an “expert” is the person, and an “expert opinion” is the result of their work. “Appraiser” is also used for people who do not hold the title of expert but who prepare assessments. In a legal context, “expert” is the preferred term; court-certified experts hold a special position of trust in court.
Yes, and this is strongly recommended. The seller or developer may not refuse the buyer’s request to consult an independent expert. During the inspection of a new building or a renovated existing property, an expert can identify defects that remain hidden from the layperson. Defects recorded in the inspection report justify claims for rectification; defects that are not reported but are obvious may be more difficult to enforce later.
Qualified publicly appointed and sworn real estate experts can be found through the Chamber of Industry and Commerce (IHK) Nuremberg for Middle Franconia’s expert database. HypZert-certified appraisers can be found on the HypZert website. In addition, associations such as the Federal Association of Publicly Appointed, Sworn, and Qualified Experts (BVS) offer search services. When making your selection, we recommend paying attention to specific reference projects in the region and to the expert’s specific area of specialization.
That depends on the purpose. Appraisals conducted in the context of an inheritance can be deducted from the estate tax as an estate liability. Reports prepared to determine the purchase price or for financing negotiations are generally considered incidental acquisition costs and must be added to the purchase price; for rental properties, they must be accounted for tax-wise through depreciation. Building expert fees related to rental properties can be immediately deducted as income-related expenses. We recommend consulting a tax advisor to clarify the tax treatment in each individual case.
