Umbrella Regulation - The Umbrella Regulation (MantelV) is a federal regulation that took effect on August 1, 2023, and uniformly governs the handling of mineral substitute building materials and soil materials in construction projects. It consolidates the Substitute Construction Materials Ordinance (ErsatzbaustoffV) and the revised Federal Soil Protection and Contaminated Sites Ordinance (BBodSchV) and applies to every building owner who handles excavated soil, construction debris, or recycled construction materials during demolition, new construction, or renovation.

Before the Omnibus Ordinance came into effect, there was no uniform federal standard in Germany for the handling of mineral waste in the construction industry. Requirements varied significantly from state to state, which had led to legal uncertainties, differing disposal costs, and, in some regions, the illegal dumping of contaminated excavated soil. The Framework Ordinance establishes a uniform framework for the first time, thereby strengthening both environmental protection and planning security for building owners.

The aim of the ordinance is to promote the recovery of mineral waste-that is, to strengthen the concept of circularity in the construction industry-while ensuring that only material that is truly uncontaminated or minimally contaminated is reused. The core principle is: recycling takes precedence over disposal, but only if the defined pollutant limits are met.

For the first time, the Framework Ordinance defines uniform limit values and material classes for mineral waste (soil, construction debris, slag) nationwide. It regulates the conditions under which substitute construction materials may be reused in road and earthworks, the requirements for sampling and analysis, and how soil material must be reused or disposed of. Core principle: Recovery takes precedence over disposal-but only if pollutant limits are met.

The material classes in the Framework Ordinance range from uncontaminated soil material (Class 0) to heavily contaminated material that may only be recycled or disposed of under special conditions.
