Direct Sale - A direct sale refers to the sale of a property by the owner without the involvement of a real estate agent. The owner handles all marketing tasks themselves, from determining the property’s value and preparing the listing to negotiating the contract and coordinating the appointment with the notary.
Anyone wishing to sell their property without an agent must be prepared for a significant investment of time and effort. The process begins with valuation: The owner must realistically assess the market value of their property. Factors such as comparable prices in the neighborhood, standard land values, and the condition of the property are taken into account. An inaccurate valuation is one of the most common mistakes in direct sales. A price that is too high deters potential buyers and prolongs the marketing period, while a price that is too low means giving away money.
In the next step, the owner creates a property listing with high-quality photos, floor plans, an energy performance certificate, and a detailed property description. The property is then listed on platforms such as ImmoScout24 or Immowelt. The cost of listings varies between 50 and several hundred euros per month, depending on the duration and placement.
This is followed by viewings, which the owner organizes and conducts themselves. Here, it is important to answer questions objectively while highlighting the property’s advantages. Experience shows that a direct sale requires significantly more viewings than professional broker-led marketing, as there is no pre-qualification of potential buyers.
The subsequent price negotiation requires negotiation skills and a clear understanding of one’s own bottom line. An emotional attachment to the property can be a disadvantage here. Finally, the owner must coordinate the notary appointment and provide all necessary documents, including a land registry extract, a declaration of division for condominiums, proof of renovations, and, if applicable, lease agreements.
The entire process takes an average of four to eight months, although the actual duration depends heavily on market conditions, the type of property, and the pricing. The time commitment for the owner amounts to at least 100 to 200 hours.
An underestimated risk in a direct sale is liability issues. The seller is legally obligated to disclose any known defects to the buyer. If the seller conceals issues such as moisture in the basement, pest infestation, or structural damage, the buyer may contest the purchase agreement or claim damages. A real estate agent is familiar with these disclosure obligations and protects both parties from legal pitfalls.
Other common mistakes include a lack of credit check on the buyer, inadequate preparation of the purchase agreement, and neglecting tax-related aspects such as the speculation period. Without professional guidance, these points are easily overlooked, which in the worst case can lead to a failed sale or financial losses.
The most frequently cited main motivation for a direct sale is the savings on the real estate agent’s commission. In Bavaria, the commission is 3.57% (including VAT) for both the buyer and the seller, totaling 7.14% of the purchase price. For a purchase price of €350,000, the seller saves around €12,500. This amount sounds attractive-but it must be weighed against the value of professional marketing, the risk of an undervalued sale price, and the time you’ll need to invest. Studies show that properties sold with an agent’s assistance often achieve higher sale prices that exceed the commission.
In the Nuremberg metropolitan area, a direct sale can make sense if there is already a specific prospective buyer, such as someone from the family circle or the neighborhood. In high-demand locations like Nuremberg’s Südstadt, Fürth, or Erlangen, a well-prepared online listing can also lead to quick success-demand is high and marketing times are short.
Nevertheless, we recommend having at least a professional appraisal conducted and having the purchase agreement reviewed by a lawyer before the notary appointment. In more complex cases, such as with communities of heirs, rented properties, or real estate with encumbrances in the land registry, we strongly advise engaging an experienced real estate agent who understands the risks and can reliably guide the sales process. The costs for a valuation (approx. €500-1,500) and a legal review (approx. €300-700) are money well spent in a direct sale.
A direct sale can be worthwhile if the owner already knows a specific buyer, the property is straightforward (such as an unencumbered condominium with no renovation backlog and clear ownership), and the owner is willing to devote significant time and effort to the sales process. At least 100 to 200 hours of personal time should be budgeted. The savings on the real estate agent’s commission must be weighed against the time investment, potential price losses due to a lack of market knowledge, and the liability risk associated with procedural errors. For complex properties, encumbered land, or complicated ownership structures, the risks of a direct sale generally outweigh the benefits.
For the sale, you will need, among other things, a land registry extract, an energy performance certificate, floor plans, a calculation of living space, a declaration of division (for condominiums), proof of renovations, and, if applicable, current lease agreements. In Nuremberg, owners can obtain the land registry extract from the Nuremberg Local Court (Flaschenhofstraße) or online via the Bavarian Ministry of Justice’s electronic land registry. The energy performance certificate can be issued by a certified energy consultant; for older residential buildings with fewer than five units, an energy demand certificate is generally required. Missing documents delay the notary appointment and can unsettle the buyer.
The greatest risks include an inaccurate price assessment, concealing defects subject to disclosure with subsequent liability consequences, and a lack of credit check on the buyer. Without experience in contract negotiations, there is also the danger of being pressured into accepting an unfavorable price. The speculation period (sale within 10 years of purchase for non-owner-occupied properties = subject to income tax) is also frequently overlooked in direct sales.
