Builder's Liability Insurance

Term from the field of Insurance

Builder’s Liability Insurance - a specialized liability insurance policy that protects builders from third-party claims for damages arising from construction activities on their own property. As builders, we have a duty to ensure public safety and are personally liable for all personal injury, property damage, and financial loss occurring in connection with our construction project.

Why builder’s liability insurance is indispensable

As soon as construction begins on a property, numerous hazards arise: falling building materials, unsecured excavation pits, contaminated sidewalks, or inadequate barriers. As a building owner, we are liable under Sections 823 et seq. of the German Civil Code (BGB) for all damages incurred by third parties as a result of our construction project. This liability applies regardless of whether we perform the work ourselves or contract it out to construction companies. Even if we hire a general contractor, the duty to ensure public safety generally remains with us as the building owner.

The builder’s liability insurance fulfills two key functions: First, it assesses whether a claim against us is justified and defends against unjustified claims-including in court if necessary. In the case of justified claims, it covers the damages up to the agreed-upon coverage limit. We recommend a coverage limit of at least 3 to 5 million euros, as personal injury claims in particular can quickly reach very high amounts. A serious accident involving a pedestrian on an unsecured construction site can result in lifelong pension payments.

The cost of builder’s liability insurance is remarkably low relative to the protection it provides: for a typical single-family home, it ranges from about 100 to 300 euros for the entire construction period. The policy is purchased as a one-time purchase and automatically expires upon completion of the construction project.

Distinction from Construction Work Insurance

Builder’s liability insurance is often confused with construction work insurance, even though the two products cover fundamentally different risks. While builder’s liability insurance covers damage to third parties, construction work insurance protects the structure itself-for example, against damage caused by storms, heavy rain, vandalism, or construction defects. Both types of insurance complement each other and should be taken out simultaneously for every construction project.

Important to know: Personal liability insurance covers construction projects only to a very limited extent, usually only minor renovation work up to a construction cost of approximately 50,000 euros. For new construction, additions, or extensive renovations, separate builder’s liability insurance is absolutely essential. If you fail to take out this coverage, you risk full recourse against your personal assets in the event of a claim-with potentially life-threatening consequences, as personal injury claims can, in the worst-case scenario, result in damages amounting to millions of euros.

Insurance Coverage for DIY Work

A frequently overlooked aspect: Even those who perform DIY work on the construction site-that is, who pitch in themselves-need builder’s liability insurance. If a builder works on the scaffolding and accidentally drops a tool on a pedestrian, they are personally liable. Furthermore, those performing their own work on their own construction site are not automatically covered by the workers’ compensation association. We recommend clearly disclosing any self-performed work when taking out builder’s liability insurance to ensure comprehensive coverage. Some insurers offer special rates for builders who perform significant amounts of their own work, which also cover the increased risk associated with self-construction.

Practical Tip for Building Owners in Nuremberg and Franconia

In the Nuremberg metropolitan region, we are currently seeing a flurry of construction activity-from new construction projects in neighborhoods like Langwasser and Röthenbach to major renovations in the Old Town or in Fürth and Erlangen. Especially in densely built-up neighborhoods with narrow sidewalks and adjacent residential areas-such as Gostenhof, the Südstadt, or St. Johannis-the risk of third-party damage is particularly high because construction sites are limited in space and pedestrians often walk close to the site. We recommend taking out builder’s liability insurance before the first shovel hits the ground and keeping the policy readily available on-site. The construction site must also be secured and illuminated in accordance with the requirements of the Nuremberg Building Authority-violations can exacerbate liability issues. Local insurance advisors in Nuremberg are familiar with regional specifics and can provide tailored quotes.

Frequently Asked Questions

When do I need builder’s liability insurance?

Builder’s liability insurance should be in place no later than the start of the first construction work-ideally as early as the first excavation or demolition work. Even preparatory measures such as tree felling, earthwork, or setting up the construction site can cause damage for which we, as the builder, are liable. We recommend taking out the insurance immediately after the building permit is issued, but no later than the day before the first scheduled work begins. In the event of a claim, the exact time the damage occurs is what counts-if insurance coverage is missing for even a single day, this can result in full liability out of your own pocket.

Is my personal liability insurance sufficient?

In most cases, no. Personal liability insurance policies cover construction projects only up to a construction cost of approximately 50,000 euros. For new construction or major renovations, as are common in Nuremberg and the surrounding area, this limit is quickly exceeded. Even if the contract does not specify an explicit upper limit, many policies completely exclude construction projects above a certain size. We recommend reviewing your own liability policy before construction begins and, if in doubt, taking out separate builder’s liability insurance. The additional cost of 100-300 euros is negligible compared to an uninsured claim amounting to millions.

How much does builder’s liability insurance cost, and what coverage amount makes sense?

For a single-family home in the Nuremberg region, costs typically range between 100 and 300 euros for the entire construction period-with multi-family homes or larger commercial projects costing correspondingly more. We recommend a coverage amount of at least 3 million euros, preferably 5 million euros. The higher coverage amount costs only a few euros more but offers significantly better protection-especially for personal injury claims, which can quickly run into the millions. Severe permanent injuries can result in decades of pension payments that far exceed a low coverage amount.
